These General Terms and Conditions of Sale are an English translation provided for information purposes. The French version remains the sole legally binding version; in the event of any discrepancy, the French version shall prevail.

 

Article 1 — Purpose and scope

These general terms and conditions of sale govern sales of bracelets and everyday stone objects (natural or reconstituted stone) concluded at a distance between the company MY MAÈV (the "Seller") and any natural person acting as a non-trader who makes a purchase on the website (the "Customer" or "Consumer"). Any order implies unreserved acceptance of these GTC, which the Customer acknowledges having read before validating their order.

 

Article 2 — Products

The Seller offers bracelets and everyday stone objects, together with associated accessories, sold from stock in a predefined configuration (standard, non-personalized products). The essential characteristics of each product are described on its page.

Products are made either of natural stone or of reconstituted, synthetic or industrial stone. The exact nature of the material is stated on each product page; the Customer is invited to refer to it before any purchase.

For products made of natural stone, the Customer is informed that variations in color, shade, veining and size are inherent to the natural character of the material and do not constitute a defect. This tolerance does not apply to products made of reconstituted or industrial stone, for which the Customer is entitled to expect a regular appearance consistent with the presentation on the website.

The photographs, illustrations and descriptions on the website are provided for illustrative purposes only. Owing in particular to the natural character of certain stones and to the display settings specific to each screen, slight differences in appearance, shade or hue may exist between the image displayed and the product actually delivered. Such reasonable variations do not constitute a lack of conformity and cannot give rise to the Seller's liability, without however depriving the consumer Customer of the legal guarantees referred to in Article 8.

 

Article 3 — Prices

Prices are shown in euros, inclusive of all taxes, excluding delivery charges, which are invoiced in addition and indicated before the order is validated. The Seller reserves the right to change its prices at any time; it being understood that the product is invoiced on the basis of the price in force at the time the order is validated.

 

Article 4 — Orders

An order is confirmed after acceptance of these GTC and confirmation of payment. A summary email is sent to the Customer. The Seller reserves the right to cancel or refuse any order in the event of a prior dispute, legitimate grounds or unavailability of the product.

 

Article 5 — Payment

Payment is made online, in full, by the payment methods offered on the website (in particular by bank card). Transactions are secured by the website's payment provider. The order is deemed effective only after confirmation of acceptance by the banking payment centres.

 

Article 6 — Delivery

Products are delivered to the address indicated by the Customer, in mainland France and within the European Union. Deliveries outside the European Union are possible on request and are subject to a prior quotation specifying the shipping costs and, where applicable, customs duties and import taxes, which are payable by the recipient. Delivery times and costs are specified at payment or in the quotation and set out in the shipping policy. In accordance with the law, if delivery has not taken place within 30 days, the consumer Customer may cancel the order and obtain a refund.

It is the Customer's responsibility to provide accurate and complete delivery information. Any reshipping costs resulting from an incorrect or incomplete address provided by the Customer, or from an unclaimed parcel, are borne by the Customer.

 

Article 7 — Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay any penalty. To exercise it, the Customer informs the Seller of their decision by an unambiguous statement (email or the model form set out in the appendix). Products must be returned in their original condition, complete and unworn.

Refund: The Seller refunds all sums paid, including standard delivery costs, no later than fourteen (14) days after being informed of the withdrawal. The Seller may withhold the refund until the goods are recovered or until the Customer has provided proof of dispatch.

 

Article 8 — Legal guarantees

Irrespective of any commercial warranty, the Seller remains bound by the following legal guarantees:

 

Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): the Customer has a period of two years from delivery of the goods to take action; they may choose between repair or replacement, subject to the cost conditions provided for by law, and are exempt from proving the existence of the lack of conformity during the twenty-four months following delivery.

Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may choose between rescission of the sale or a reduction in price, within two years of discovering the defect.

 

 

Article 9 — Liability and force majeure

Bracelets and stone objects are decorative and fashion items. No therapeutic, medical or health-related virtue may be attributed to them or guaranteed by the Seller. The Seller cannot be held liable for any use that does not comply with the intended purpose of the products.

 

Article 10 – Personal Data

The processing of the Customer's personal data is governed by the Privacy Policy available on the Website.

Article 11 – Consumer Mediation

In accordance with the provisions of the French Consumer Code relating to consumer dispute resolution, after first submitting a written complaint to the Seller and if no satisfactory response is received, the Customer may refer the dispute free of charge to the following consumer mediator:

Article 12 – Governing Law and Dispute Resolution

These General Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of France.

Any dispute between the Seller and a business Customer (acting for purposes relating to its commercial, industrial, craft or professional activity) shall fall under the exclusive jurisdiction of the courts having jurisdiction over the Seller's registered office (Paris, France), including in cases involving multiple defendants, third-party proceedings or summary proceedings.

For any dispute involving a consumer Customer, French law shall apply without depriving the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence. The consumer is encouraged to seek an amicable settlement first by submitting a prior written complaint and, where applicable for customers within the European Union, by referring the matter to a consumer mediator as set out in Article 11. Failing an amicable resolution, the statutory rules governing jurisdiction for consumer disputes shall apply, and the consumer shall retain, in particular, the right to bring proceedings before the courts of their place of residence where permitted by law.
